Terms and Conditions

Welcome to ARTSELL. By accessing or using our services, you agree to comply with the following Terms and Conditions. These govern all collaborations, bookings, and content usage between ARTSELL, clients, photographers, videographers, and influencers.

1. Intellectual Property & Usage Rights

• All photos, videos, or creative content submitted or produced under ARTSELL are the exclusive property of ARTSELL.
• We reserve the right to use such content for marketing, social media, advertisements, and promotional purposes.
• No artist or influencer may claim ownership, resale, or separate distribution rights of such content.

2. Client Bookings & Cancellations

• A 30% advance payment is required to confirm all bookings.
• Bookings are non-refundable. Cancellations require full payment of the agreed fee.
• Rescheduling may be permitted upon request and at the discretion of ARTSELL.

3. Artist & Influencer Responsibilities

• Direct communication with ARTSELL clients is strictly prohibited without prior written consent. Any breach will result in a ban and potential legal action.
• Artists must not cancel confirmed assignments. If unavoidable, a replacement artist of equivalent skill must be arranged at least 48 hours in advance.
• A standard workday is 8 hours. Overtime will incur an extra 15% charge per hour, payable by the client.
• Late submissions will result in a 5% deduction from the artist's payment.
• If the delivered work is not up to quality or on time, ARTSELL reserves the right to deduct up to 15% from the agreed payment.

4. Influencer Engagement

• Influencers are graded internally and compensated based on experience, reach, and campaign type.
• Remuneration per campaign will be discussed and confirmed before each engagement.
• Influencers must not communicate or negotiate directly with ARTSELL clients.

5. Agreement Duration

• Each agreement or collaboration will have a clearly defined start and end date.
• Both parties may terminate the agreement with notice, provided all pending obligations are fulfilled.

6. Confidentiality

• All collaborators must treat all information, including client data and project details, as strictly confidential. Disclosure of such information may result in termination and legal action.

7. Legal Jurisdiction

• These terms are governed by the laws of the People's Republic of Bangladesh. Any disputes will be resolved under the Arbitration Act 2001, with arbitration held in Dhaka.

8. Acceptance of Terms

By using ARTSELL's services or working with ARTSELL, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
